Terms and Conditions
By registering as a customer or using this website you agree to these Terms and Conditions Pricing The pricing is based on the number of leaseholds (plus the freehold) that appear on the freehold document. Land registry charges are included in the price shown. Land Registry Prices may vary however and the actual cost of obtaining the documents will be passed on to you as necessary. Service Level Agreement All time scales given are reasonable endeavours; some aspects of requests are beyond our control; in particular if a request contains - Leasehold or freehold registers not electronically available - Flats requiring SIM searches to confirm status then we will return the information as soon as practical but the SLA may not be met as the information is sent via the postal system or information may need confirming. Request with less than 50 leaseholds - Extracted data to normally be available within 24 hours of receipt of request (48 hour will normally be the maximum) Request with more than 50 leaseholds - The target will be to make extracted data to available within 48 hours of receipt of the request (72 hours will normally be the maximum), this is subject to the number of flats on the request and for large numbers the delivery date may be negotiated as necessary Downloaded register documents to normally be available within 24 hours of receipt of request Copy Lease documents where a copy is held in electronic form by the registrar to normally be available within 24 hours of receipt of request (48 hour maximum), where a copy is not held in electronic form by the registrar would be subject to the Land Registry and postal service so no SLA can be given. The working days are Monday to Friday Quality of Extraction The extracted data will be visually compared against the printed register view; any discrepancies will be corrected before the information is released. This will provide assurance that extracted data is free from errors and accurately reflects that found in the register views. Liability Whilst the quality of the extracted data is of paramount importance no liability will be accepted for loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with the extracted data, its use or otherwise, except to the extent set out below or to the extent that such liability may not be lawfully excluded. The maximum aggregate liability of ESB Extract Limited whether in contract, tort, negligence, statutory duty or otherwise, for any loss or damage whatever arising from or in any way connected with any liability not excluded by this Agreement shall be limited to the amount of the fee paid for the service excluding Land Registry Fees. |
